Daily working hours

Monthly working hours

Article 63 of the Labor Law has declared Friday and May 11, which is Labor Day, as holidays for employees and workers. On these days wages, benefits, and insurance will be calculated for the workers.

The calculation of the monthly working hours of the Ministry of Labor for workers in a month is as follows: the number of working days in a month will be multiplied by 7.33 and the amount of monthly salary will be determined.

Monthly working hours: number of non-holiday days of the month x 7.33

The types of shift work in the labor law are as follows:

  • morning and evening

How to calculate the working hours per month for each of these and the amount of overtime is different. For special working hours, such as firefighters, the shift coefficient is used.

Calculation of overtime hours

In the calculation of working hours according to Article 51 of the Law of the Ministry of Labor, the 44 hours a worker gives to the employer during the week is considered as working hours, and if he works more than these hours in the group, it will be calculated as overtime hours.

Now, if the employer needs the worker to work overtime, he must agree with him and take the necessary measures according to the terms of Article 59 of the Law of the Ministry of Labor and Social Welfare Affairs.

Generally, two situations occur for workers:

  • Workers and employees work more hours in the week and after their daily working hours.
  • Employees and workers should be at their workplace and work on official holidays.

In the calculation of working hours and according to the rules we mentioned, if a worker works more than his mandatory working hours, he will be entitled to receive overtime. In order to do overtime, the agreement of the worker and payment of 40% more than the wage for each hour of work must be considered.

In most collections and companies, salary calculation is done monthly and the overtime amount will be calculated and paid at the time of salary payment, unless another agreement is made with the employer.
